SPAR Gift Card Terms and Conditions


GENERAL CONDITIONS
 
  1. The Party purchasing the Gift C ard (the “Purchaser”) and the Card Holder (being the party whose signature appears on the Gift Card) both agree to the terms and conditions stipulated herein.
  2. A valid form of identification and proof of residence and any document that may be required in terms of FICA Legislation (for the purposes of using the Gift Card) is required when purchasing and using the Gift Card.
  3. The Gift Card can only be redeemed in store and cannot be used for any other purchases (including but not limited to electronic purchases, banking transactions and payment of any liabilities).
  4. Expiration: The Gift Card is valid until the last day of the month which is printed on the front of the card (marked expiry date). Subject to 1.5 below, in event of the Gift Card expiring and there is still a surplus funds therein which the customer is entitled to, a new Gift Card will need to be acquired by contacting the SPAR customer care department on 0860 313 141 and the issuing of a new Gift Card will come at a reasonable charge as advised by SPAR and payable by the Card Holder.
  5. Regardless of whether or not a Gift Card has expired, it is recorded that a Card Holder shall only be entitled to utilise and have access to the funds contained on a Gift Card for a period of three years after the funds have been loaded onto the Gift Card.
  6. A Gift Card can be loaded with a minimum of R100 (One hundred rand) and a maximum of R5000 (Five thousand rand)but may be subject to change(at SPAR’s sole discretion) without notice.
  7. The amount registered on the Gift Card will not accrue any interest.
  8. The Gift Card is redeemable at any of the following SPAR Branded stores in South Africa, namely, SUPERSPAR, SPAR, KWIKSPAR, SPAR Express, SaveMor, TOPS at SPAR, SaveMor Liquors and Build IT (the “SPAR Brands”).
  9. The Card Holder shall append his/her signature to the back of the Gift Card. An unsigned Gift Card cannot be used.
  10. The Card Holder will be required to sign the transaction slip of the goods purchased with the Gift Card.
  11. The Gift Card shall not be used by any person other than the Card Holder.
  12. The total Rand amount of the purchases will be deducted from the value of the Gift Card.
  13. In the event that an intended purchase exceeds the available credit on the Gift Card, the Card Holder will be required to either :

    a. Pay the difference between the total value of the transaction and the amount available on the Gift Card; or

    b. Remove items/ products to bring the total value of the transaction to or below the available credit on the Gift Card.
  14. It is the responsibility of the Card Holder to ensure that the Gift Card is used only for lawful transactions.
  15. The Gift Card (including any balance remaining from time to time) may not be refunded or exchanged for cash or credit.

  18. Lost/ stolen and damaged Gift Cards:

    a. Where a Gift Card has been lost or damaged, the Card Holder shall be required to immediately cancel the card via the website www.whatsonmycard.com.

    b. SPAR will not be responsible for any purchases on the Gift Card prior to the card being cancelled. All risks in this regard shall remain with the Card Holder.

    c. In event that the Card Holder wishes to acquire a new card, they shall contact the SPAR customer line on 0860 313 141 and such card will be at a reasonable charge (as determined by SPAR) which will be paid by the Card Holder.
  19. The SPAR Group LTD and any independent retailer conducting business under any of the Spar Brands (an “Independent Retailer”) will not be held liable for damage, loss, theft or copying of the Gift Card or any malfunctions with respect to the instore point of sale equipment.
  20. To the extent relevant, the purchase and use of this Gift Card is governed by the Standard Bank Rules and Regulations for credit cards (as updated from time to time) and which is available at www.standardbank.co.za/termsandconditions
  21. In the event that there is any conflict between the provisions of these terms and conditions and the aforesaid Rules and Regulations, the Rules and Regulations shall take preference and prevail.
  22. Exchange and returns goods following the use of a Gift Card shall be governed by the usual processes applicable for goods purchased with cash however, both the receipt and the Gift Card must be presented.
  23. Neither the SPAR Group Limited nor the Independent Retailers provide any warranties, insurance or any other promises not specifically set out in these terms and conditions.
  24. The Card Holder may not vary from the terms and conditions as set out above.
  25. South African Law governs these terms and conditions.
  26. A Gift Card cannot be resold by the Card Holder and is not transferable.
  27. A Purchase Authorisation will be declined if any of these terms and conditions are breached.
  28. Provisions herein may constitute a benefit for a third party (stipulatio alteri) and may be accepted by such party at any time.
