1. Introduction
The SPAR2U Click & Collect service enables customers to purchase products through the SPAR2U platform and collect such products from a participating SPAR store.
2. Store Participation
Click & Collect is available only at participating SPAR stores and is subject to store capacity, operating hours and product availability.
3. Collection Times
Collection time slots are estimates and may vary based on operational requirements, demand or unforeseen circumstances.
4. Customer Collection Responsibility
The customer is responsible for collecting the order during the selected collection period.
5. Identification Verification
SPAR reserves the right to verify the identity of any person collecting an order.
6. Authorised Third-Party Collection
Customers may nominate another individual to collect an order on their behalf. SPAR may require proof of authorisation and identification.
7. Product Availability
All products displayed on the platform are subject to availability at the selected store. SPAR reserves the right to substitute products, remove unavailable items or refund unavailable items.
8. Pricing
The price charged shall be the price displayed on the SPAR2U platform at the time of order confirmation unless an obvious pricing error has occurred.
9. Payments
Full payment must be authorised through approved payment methods before collection.
10. Cancellations
Customers may cancel orders while the order remains in Created status. Following commencement of order picking, cancellation rights may be restricted.
11. Uncollected Orders
Where an order is not collected, SPAR may attempt to contact the customer. Perishable goods may be discarded where required for food safety reasons. Refunds may be adjusted to reflect products that can no longer be resold.
12. Returns and Refunds
Returns and refunds shall be handled in accordance with SPAR returns policy, the Consumer Protection Act, 2008 and applicable South African law.
13. Age-Restricted Products
Age-restricted products may only be collected by persons legally entitled to purchase such products and who can provide valid identification.
14. Limitation of Liability
SPAR shall not be liable for failure by the customer to collect an order, delays caused by circumstances beyond SPAR's reasonable control, or losses arising from unauthorised use of collection information.
15. Privacy
Personal information will be processed in accordance with SPAR privacy policy and applicable privacy legislation.
16. Amendments
SPAR reserves the right to amend these Terms and Conditions at any time. The version published on the SPAR2U platform shall apply.
17. Governing Law
These Terms and Conditions shall be governed by the laws of South Africa.
